About Arthur Mazirow, Esq.
Arthur Mazirow received his Bachelor of Science Degree from the UCLA Anderson School of Management and his Juris Doctor degree from the UCLA School of Law.
Legal Experience
For many years he was a transactional real estate attorney representing clients in several thousand industrial and commercial real estate transactions involving:
• Purchases Transactions. Representing purchasers of real estate in acquiring or purchasing different types of real estate, including raw land for development, land ready for development, improved real estate consisting of industrial building developments, office building developments, retail developments, shopping center developments, residential developments, and apartment house developments.
• Sales Transactions. Representing sellers of real estate in selling different types of real estate, including raw land, improved real estate consisting of industrial developments, retail developments, shopping centers, residential and apartment house developments.
• Leases representing the landlord (excluding ground leases). Lease transactions representing a lessor in the leasing of improved real estate, including industrial properties, office properties, retail properties, shopping center properties, on buildings already built or to be built.
• Leases on behalf of Tenants (excluding ground leases). Representing tenants in lease transactions concerning real estate of all types, including industrial properties, office properties, retail property, shopping center properties, including buildings already built and to be built.
• Leases on behalf of Landlords concerning ground leases. Representing the lessor in ground leases in retail, office and individual developments.
• Leases, tenant representation in ground leases. Lease transactions representing the tenant in ground leases.
• Real Estate Loan Transactions. Representing borrowers or lenders in loan transactions, including purchase money loans, land loans, construction loans and permanent loans involving different types of real estate including raw land, improved real estate, industrial developments, office building developments, retail developments, shopping center developments, residential and apartment houses.
• Real Estate Brokerage Matters. Matters involving real estate brokerage concerning listings for sale, for lease, loan transactions, disputes between brokers, disputes between brokers and sellers, buyers, tenants, lessors, lenders, lending institution or sales people and the preparation of real estate brokerage contracts and forms on behalf of real estate associations, individual brokerage companies, sellers, buyers and tenants.
• Real Estate Developments. Representing the developer in real estate developments concerning industrial projects, office projects, retail projects, retail developments and shopping center projects.
• Real Estate Litigation. Real Estate litigation representing either the buyer, the seller, the lessor, the tenant, the lender, the borrower, the title company, adjoining land owners, owners, or contractors concerning various types of real estate disputes, including purchase and sale matters, landlord/tenant matters, title issues, lien disputes, partnership disputes and arbitrations or all types of real estate.
• Partnerships. Representing partnerships or partners concerning a partnership dealing with a real estate project.
• Forms of Printed Leases. Preparation of lease forms to be used on a mass basis concerning single tenant industrial/commercial net lease forms, single tenant industrial/commercial gross lease forms, office leases, net lease forms, office leases gross lease forms, multi-tenant lease forms, including various addenda thereto on behalf of real estate brokerage associations or on behalf of landlords or tenants.
• Forms of Printed Purchase and Sale Documents. Preparation of forms of contracts, option contracts, letters of intent, and proposals for the purchase and sale of real estate on behalf of real estate brokerage associations, real estate brokers and buyers.
• Title Matters. Representing parties on issues concerning title matters, including easements, encroachments, boundary line disputes, surveys, easements in gross, easements appurtenant, implied reservations of easements, implied grants of easements, and co-ownership matters.
• Construction Contracts. Representing parties to a construction contract for the construction of a project.
He now limits his practice to acting as a neutral arbitrator of real estate disputes. However, from time to time he does act as a mediator of real estate disputes and as an expert witness. He has also been designated by real estate litigants as the trial referee under the judicial reference procedure of California Code of Civil Procedure Section 638(a).
The disputes that have come before him in his capacity as an arbitrator, mediator and expert witness have included:
Disputes between lessor and lessee concerning office, commercial and industrial leases and ground leases on various issues including:
• interpretation of expense allocation provision
• determination of fair market rent
• letters of credit and security deposits
• repair obligations
• options
• interpretation of leases
Disputes between buyers and sellers of real estate concerning land, industrial property, office projects, commercial property and residential property on various issues including:
• damages for breach of contract to convey title
• suits for specific performance
• return of deposits to buyer
• interpretation of contractual provisions
Disputes concerning title insurance issues on various issues including:
• title insurance coverage
• malicious prosecution
Disputes between real estate brokers and clients on various issues including:
• broker claims against clients of broker
• claims against brokers
• claims between brokers
Disputes between partners in real estate ventures on various issues including:
• damages for breach of fiduciary duties owed to joint venturers
• interpretation of joint venture development agreement
Title disputes including:
• easements
• boundaries
• covenants, conditions and restrictions
Legal malpractice
• standard of care of lawyers concerning real estate leases,
purchase and sale agreements
Lectures
He has lectured extensively in programs sponsored by the UCLA Extension, University of California Santa Barbara Extension, University of California Irvine Extension, the State Bar of California, the Los Angeles County Bar Association, The Practicing Law Institute, CLE International and various real estate groups on real estate law and practice concerning the leasing, selling and purchasing of commercial, retail and industrial property, real estate negotiation skills, the California law of contractual arbitration, ground leases, industrial and commercial real estate development and joint ventures.

Articles Written/Forms Published
He has also written and published more than 100 articles dealing with the legal aspects of real estate transactions.
From 1972 to 1990 he was a principal author of the lease and purchase forms published by the American Industrial Real Estate Association.
He is a member of the Complex Case Panel of the National Roster of Arbitrators of the American Arbitration Association, the Section on Real Property and the Subsection on Construction and Development of the State Bar of California; the Real Property Section of the Los Angeles County Bar Association; the Real Property, Probate and Trust Law Section of the American Bar Association; the Dispute Resolution Section of the American Bar Association, The Counselors of Real Estate (CRE), he is the 2007 Chair of the CRE Dispute Resolution Program Committee and a member of the State Bar of California.
